Oh hello there! I didn't see you there. On this week of "Caleb Explains the Law", I will be talking about the concept of Ex Post Facto Law. Ex Post Facto law is the concept that a law can go into effect before it was even passed. For example if MLB has passed a law saying that anyone who had or is continuing to take performance enhancing drugs would be disqualified from the MLB, that would be an example of Ex Post Facto law. Basically Ex Post Facto is being able to punish someone for doing something BEFORE the law had come into effect.

For further illustration I will now tell the story of Little Timmy, an individual who lives in the future.

Once upon a time, there was a boy named little Timmy, in the city of New Kortane. Little Timmy lived in the year 2231. A dystopian government reigned, the populace was controlled with tight surveillance. A triumvirate of cyborg judges were in control, half man and half machine. Little Timmy had a tough childhood, in a bleak city, with many lights and artificial beauty, but underneath was hopelessness and decay. The only part of his childhood was the few boxes of Lego his father found discarded under a dumpster. But even this would come back to haunt little Timmy.

One of the three cyborgs that composed the Triumvirate that ruled New Kortane, was in charge of the judicial and lawmaking system. He mostly used this power to keep all citizens in fear of the Triumvirate and their law enforcing force, the Corez. Every once in a while when their slave labor camps needed more workers he would make a new law, however absurd, that would be enforced quickly and anyone who had ever committed the crime would either be executed or shipped off, likely to be never seen again. The Triumvirate kept a close watch on all the populace through the surveillance cameras covering nearly every single square inch of the city. Law #21302 reads, "Any member of the New Kortane society, whether male or female, old or young, that have ever played with a blasphemous building toy, such as Lego, has committed treason against the Triumvirate and the people of New Kortane. All offenders are to rounded up and be punished by forced labor. However, if any of the citizens have played with the clone brand MegaBloks they will be executed immediately by a shock treatment or killed on site by law enforcement."

Are you seeing the analogy here? Try to open up your mind to seeing the consequences of a nation that allows its legislature to use Ex Post Facto law within their nation.

Little Timmy grew up, and no longer was called little Timmy, instead he was known by the name Big Tim to his friends. That is the friends he had left. Most of his friends had either been pressed into the Corez and given a MindWipe, or in a slave camp, or just plain dead. Big Tim married the woman that was appointed to him, and worked in a repair shop repairing the Corez's jeeps. On a fateful day he was just about to leave to go home when he heard the newest law being announced over the PA system. Big Tim had been considerably lucky so far and had not been found guilty of any of the laws the Triumvirate had put into effect. But, when he heard Law #21302 he turned pale. He hurriedly walked home. He knew that because of his playing with Lego when he was a boy he was not a enemy of the Triumvirate. He came in the front door and hurried to his bathroom. The bathroom was the only place not under surveillance, and Big Tim had always felt he did his best thinking on the pot anyway. He plopped down and began to consider what he should do. His only hope was that somehow the Triumvirate would somehow forget the recordings of him playing with the incriminating bricks. But the Triumvirate never forgets. He heard banging on his front door then seconds later two Corez officers came blasting through his bathroom door. Big Tim yelled and jumped off the pot, grabbed the plunger and smacked one of the officers on his helmet. Seconds later he had been tazed and handcuffed. He was then led away while his neighbors turned away embarrassed and ashamed. The worst part was that he wasn't even wearing pants...

Ex Post Facto law is an important thing to protect our nation from and it is banned by our Constitution. Perhaps this will lead us better respect our Constitution and the wisdom of the Founding Fathers.
